2010 Harley Raffle First Annual Harley Davidson Motorcycle Raffle 2010 Harley Davidson Raffle Official Rules - Sponsored by angelonmyshoulder.org Angel On My Shoulder, a registered 501(c)(3) non-profit organization. Angel On My Shoulder reaches out to the cancer-affected community through its programs which include: Uplifting Angels, visits to over 60 clinics and hospital and over 6000 patients twice a year; Camp Angel and Camp Teen Angel, weekend camps for kids affected by cancer; Angel Care, weekend retreats for Cancer Caregivers; Healing Angels, for people who have completed their cancer treatments; Guardian Angels which recognizes and honors cancer caregivers; Angel Scholarship program; and, our Angel Wings program which grants requests. Our programs are financed by our major fundraisers: the Angel On My Shoulder Golf Spectacular, Polar Bear Plunge, Cruzin For A Cause, Cathy's Ice Cream Social, Evening of Angels Wine Tasting, 2010 Angel Harley Raffle plus the generosity of people like you through personal fundraisers, gifts and donations. Please visit angelonmyshoulder.org for more info and how you may help. DONATIONS For each $20.00 donation, a single raffle entry will be generated for the donor at time of sale. All tickets bought via the website at http://angelharleyraffle.com will have a unique transaction ID that will constitute as your official Receipt of ticket/s purchased and that number will match our website records and will represent the purchasers portion of ticket in said raffle and be delivered instantly via supplied email address of purchaser and also represent as paid receipt of said ticket, excluding in person ticket buys, and placed in our official ticket bin for the drawing and use the info supplied by you during checkout on-line. All tickets portions bought on-line as stated above will be delivered via instant e-mail deli vary. A "donation" shall not occur and be binding on Angel On My Shoulder until funds received for the same have cleared the bank. PayPal accounts and most major credit cards are acceptable for online donations. Raffle donations may be made online at angelharleyraffle.com or in-person at any site designated as an official outlet or where Angel On My Shoulder Harley is on display. Donations are not tax deductible. Please Note: US Postal Regulation do NOT allow ticket stubs to be mailed via US Mail. We will fill out any and all ticket and place in drum for drawing for all on line purchases. Each donation shall constitute an "entry" into the raffle drawing, and the person to whom the entry is registered shall be the "entrant." Although more than one name may be provided on the entry registration form, the entry shall be registered to the first name listed, who shall constitute the sole Entrant for that ticket. The winning Entrant shall be the "winner" of the prize. Transfer of prize ownership will be made to the Entrant. The winner must supply his/her social security number before the prize is tendered. It is the sole responsibility of the Entrant to allocate a winning prize to other participants in case of a multiple entry registration, and the winning Entrant shall hold harmless Angel On My Shoulder in case of conflicting claims or disputes among multiple claimants. VOID WHERE PROHIBITED OR RESTRICTED BY LAW This raffle is conducted in accordance with gaming laws enacted and enforced by the State Of Wisconsin Gaming rules and void in areas prohibited or restricted by law. Raffle promoters and/or Angel On My Shoulder are not responsible for lost or stolen entries. Raffle entries will be disqualified, at the sole discretion of Angel On My Shoulder, if attempts are made to disrupt the Raffle or circumvent the terms and conditions of these Official Rules. If the above occurs, Angel On My Shoulder reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Angel On My Shoulder that is fair and equitable to Raffle participants. Angel On My Shoulder, its members, officers, directors, agents, and representatives and their parent organizations, affiliates, subsidiaries, and advertising, promotion and legal advisers are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Raffle of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of Angel On My Shoulder that may cause the Raffle to be disrupted or corrupted (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Raffle; or (vii) any printing or typographical errors in any materials associated with the Raffle. QUANTITY OF ENTRIES The maximum number of entries offered via donation is 2,000. Requests for entries and therefore donations received after all entries are assigned or following the drawing, will be returned to the entrant(s). ELIGIBILITY Entrants must be legal residents of the United States and 18 years of age or older on, or before, June 11th, 2010. The Entrant must supply his/her social security number to receive prize. If an Entrant's check or credit card is dishonored prior to the drawing, the entry ticket will be declared invalid, until a replacement donation is received. All check or credit card charges found dishonored after the drawing must be honored. A $20.00 charge will be assessed for non-sufficient funds or stop payment checks. DRAWING The raffle drawing will take place on June 11th, 2010 at the Angel On My Shoulder Golf Spectacular. Or earlier if all tickets are sold out. Winners name and likeness will be used and added to the website within 24 hours of drawing date. If not depleted prior to the official prize drawing, entries will be available via in-person donation until the day of the drawing. If not depleted prior to the official prize drawing, online entries must be completed and in the possession of Angel On My Shoulder by 7:00 p.m. CDT on thursday, June 10th, 2010. The winner, does not need to be present at the time of the drawing and will be notified by Angel On My Shoulder within 7 business days of the drawing. It is the responsibility of the donor/entrant to provide a valid, mailing address, phone and/or email address for notification. PRIZE The prize winner for the June 11th, 2010 drawing will be awarded a 2010 Harley Davidson Street Glide with an official retail value of $20,250, or $15,000 cash in lue of receiving motorcycle. Winner does not need to be present at the drawing but must present their entry stub when claiming the prize. The winner must claim their prize within 14 days from notification, per directions provided in the notification letter. He/she is responsible for picking up the Motorcycle on a date, time and site within Racine WI designated by Angel On My Shoulder. Failure to claim the prize within 14 days will result in forfeiture of the prize. All federal, state and local income, sales and/or excise taxes, fees, assessments and like charges associated with the the prize, are the responsibility of the holder of the winning ticket. The IRS has taken the position that amounts donated for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution. Winner must complete a W-9 form before receiving prize. For further information, consult your qualified financial adviser. In the event a minimum of 2,000 donations are not received by June 11th, 2010, Angel On My Shoulder reserves the right to withdraw the motorcycle prize and pay 50% of the net proceeds up to $20,000 to one winner. WAIVER/LIMITATIONS OF LIABILITY Entrants release Angel On My Shoulder, board of directors, committee members, officers, volunteers, and representative agents from any and all liability with respect to participation in the promotion and possession of the prize. Any liability of Angel On My Shoulder shall be limited to the donation amount. In case of a dispute, Angel On My Shoulder decision shall be final. Angel On My Shoulder is not responsible for lost or stolen tickets. Entrant agrees to allow Angel On My Shoulder to use his/her name and/or image without any compensation for any promotional activity related to this or any future raffle.
